{"id":137,"date":"2016-04-07T09:15:53","date_gmt":"2016-04-07T13:15:53","guid":{"rendered":"http:\/\/eagleassociates.net\/news\/?p=137"},"modified":"2016-04-13T17:18:36","modified_gmt":"2016-04-13T21:18:36","slug":"disclosure-requests-for-legal-proceedings","status":"publish","type":"post","link":"https:\/\/eagleassociates.net\/news\/2016\/04\/disclosure-requests-for-legal-proceedings\/","title":{"rendered":"Disclosure Requests for Legal Proceedings"},"content":{"rendered":"<p>Disclosure of protected health information (PHI) for use in legal proceedings is permitted under certain circumstances.\u00a0 If a covered entity receives a court order that is signed by a judge, requesting PHI, it should comply with the order and provide the information that is specifically requested.<\/p>\n<p>If the practice receives a subpoena, discovery request, or other lawful process that is not accompanied by a signed order of the court, certain<i> satisfactory assurances<\/i> must be obtained from the requesting party prior to disclosure of the requested information.<\/p>\n<p>In these instances, the requesting party must provide the practice with either of the following:<\/p>\n<ul>\n<li>Satisfactory assurances that reasonable efforts have been made to give the individual (whose information has been requested) notice of the request; or<\/li>\n<li>Satisfactory assurances that the party seeking such information has made reasonable efforts to secure a qualified protective order (see below) that will guard the confidentiality of the information.<\/li>\n<\/ul>\n<p>Please refer to the article, <i>Requests for Disclosure of PHI for Legal Proceedings<\/i>, in the April issue of the <i>Advisor<\/i>\u00ae, for more information regarding satisfactory assurances and documentation requirements.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Disclosure of protected health information (PHI) for use in legal proceedings is permitted under certain circumstances.\u00a0 If a covered entity receives a court order that is signed by a judge, requesting PHI, it should comply with the order and provide the information that is specifically requested.
